The judge called the dog “immediate family” under the law’s “zone of danger” doctrine.
Nan DeBlase was nearly hit herself while walking Duke when a car blew through a stop sign last July in Brooklyn.
Surveillance footage showed her narrowly escaping as the dog was fatally struck.
“This court fails to see why a beloved companion pet could not be considered immediate family,” wrote Judge Aaron Maslow, making an exception to laws that typically treat pets as property.
The dog’s owner, Trevor, was not granted emotional damages as he wasn’t present at the scene.
